MINUTES OF THE CITY COUNCIL MEETING
OF THE CITY OF GLENN HEIGHTS, TEXAS
August 25, 2008

On this the 25th day of August 2008 the City Council of the City of Glenn Heights met in a special meeting at the Glenn Heights City Hall in Glenn Heights, Texas located at 1938 S. Hampton Road with the following members present:

Mayor Choate called the meeting to order at 7:31 p.m.

INVOCATION: Pastor Larry Eastman - Ovilla Church of the Nazarene

Councilwoman Chancellor arrived at 7:33 p.m.

PUBLIC COMMENTS:

None

1. JOINT PUBLIC HEARING

1. The City Council and the Planning and Zoning Commission will hold a Joint Public Hearing to receive testimony relative to an Amendment to the Citys Zoning Ordinance, Ordinance No. O-10-08, by establishing the zoning classification on approximately 14 acres of land described as a part of the W.P. Holman Survey, Abstract No. 619, Glenn Heights, Dallas County, Texas to a Planned Development (PD) District zoning, by specifically amending PD No. 1, situated in the W.P. Holman Survey, Abstract No. 619, located in the City of Glenn Heights, Dallas County, Texas, to add said approximately 14 acres with a base zoning of Business Park District (BP) and Single Family Residential District - 4 (SF-4) within PD No. 1 and providing development standards.

Presentation by Interim City Manager, Phillip Prasifka with an explanation of the history regarding the proposed expansion of the DART Park and Ride.

Councilman Freeman moved to open the public hearing. Mayor Pro Tem Dixon made the second. The motion carried with the following vote:

VOTE: 6 Ayes - Holley, Freeman, Dixon, Choate, Chancellor, and Harvey

Councilman Pereira arrived at 7:39 p.m.

Mayor Choate opened the public hearing.

The following citizens spoke for the expansion but against allowing the live vegetative (or live green) screening wall. Most citizens wanted the landscaping and the six foot masonry screening wall.

Sli Rabiee, P.E., Senior Manager Area Mobility Programs, with DART was present to answer questions.

Mayor Pro Tem Dixon moved to close the public hearing. Councilman Freeman made the second. The motion carried with the following vote:

VOTE: 7 Ayes - Holley, Freeman, Dixon, Choate, Chancellor, Harvey, and Pereira

Councilman Freeman moved to recess the meeting. Councilwoman Chancellor made the second. The motion carried with the following vote:

VOTE: 7 Ayes - Holley, Freeman, Dixon, Choate, Chancellor, Harvey, and Pereira

Mayor Choate recessed the meeting at 7:57 p.m.

Mayor Choate called the meeting back to order at 8:42 p.m.

Councilman Freeman moved to reconvene. Mayor Pro Tem Dixon made the second. . The motion carried with the following vote:

VOTE: 7 Ayes - Holley, Freeman, Dixon, Choate, Chancellor, Harvey, and Pereira

2. Consider and adopt an Ordinance of the City Council of the City of Glenn Heights, Texas, amending the City's zoning ordinance, Ordinance No. O-10-08 and amending Planned Development No. 1 as established by Ordinance 348-85A on July 21, 1985, providing that approximately 14 acres of land be made a part and added as part of said Planned Development No 1; providing for PD-BP (Planned Development - Business Park District) and PD-SF-4 (Planned Development - Single Family Residential District - 4) zoning classification on approximately 14 acres of land described as a part of the W.P. Holman Survey, Abstract No. 619, Glenn Heights, Dallas County, Texas.

Janice King, 1924 High Meadow - addressed the Council on the need to get the cars off the streets and spoke for the need of a masonry screening wall.

Councilman Pereira moved to approve Ordinance O-25-08 amending Planned Development No. 1 as established by Ordinance 348-85A on July 21, 1985, providing that approximately 14 acres of land be made a part and added as part of said Planned Development No 1; providing for PD-BP (Planned Development - Business Park District) and PD-SF-4 (Planned Development  Single Family Residential District  4) zoning classification on approximately 14 acres of land described as a part of the W.P. Holman Survey, Abstract No. 619, Glenn Heights, Dallas County, Texas as presented with one change delete number 3, Section 7 (all required screening would follow current code). Councilman Freeman made the second. The motion carried with the following vote:

VOTE: 7 Ayes - Holley, Freeman, Dixon, Choate, Chancellor, Harvey, and Pereira

3. Consider and take action on amending Garage Sale Ordinance, Section 4.7 to allow non-profit organizations to hold garage sales.

Janice King, 1924 High Meadow - requested the code be amended to allow all non-profit organizations be able to hold garage sales.

Councilman Pereira moved to approve Ordinance O-27-08 amending Article VI, Section 3.3, "Garage or Home Sales," of the Unified Development Code, City of Glenn Heights, Texas, to provide regulations of nonprofit organizations as they pertain to garage sales, yard sales, estate sales, moving sales, expanding subsection 3.3(a) to provide a definition of nonprofit organizations and adding a new subsection 3.3(g) "Sales by nonprofit organizations and that that circumstances involving public urgency or other important public purpose require that the ordinance be adopted after consideration at only one meeting. Mayor Pro Tem Dixon made the second. The motion carried with the following vote:

VOTE: 7 Ayes - Holley, Freeman, Dixon, Choate, Chancellor, Harvey, and Pereira

4. Consider and take action on Special Events application of Gateway Estates Homeowners Association.

Councilwoman Chancellor moved to reconsider Item 2. (Consider and adopt an Ordinance of the City Council of the City of Glenn Heights, Texas, amending the Citys zoning ordinance, Ordinance No. O-10-08 and amending Planned Development No. 1 as established by Ordinance 348-85A on July 21, 1985, providing that approximately 14 acres of land be made a part and added as part of said Planned Development No 1; providing for PD-BP (Planned Development - Business Park District) and PD-SF-4 (Planned Development  Single Family Residential District  4) zoning classification on approximately 14 acres of land described as a part of the W.P. Holman Survey, Abstract No. 619, Glenn Heights, Dallas County, Texas) and declare that circumstances involving public urgency or other important public purpose require that the ordinance be adopted after consideration at only one meeting. Councilman Harvey made the second. The motion carried with the following vote:

VOTE: 7 Ayes - Holley, Freeman, Dixon, Choate, Chancellor, Harvey, and Pereira

5. ADJOURNMENT.

Councilman Freeman moved to adjourn. Mayor Pro Tem made the second. The motion carried with the following vote:

VOTE: 7 Ayes - Holley, Freeman, Dixon, Choate, Chancellor, Harvey, and Pereira

Mayor Choate adjourned the meeting at 9:33 p.m.
