MINUTES OF THE CITY COUNCIL MEETING
OF THE CITY OF GLENN HEIGHTS, TEXAS
October 20, 2008

On this the 20th day of October 2008 the City Council of the City of Glenn Heights met in a regular meeting at the Glenn Heights City Hall in Glenn Heights, Texas located at 1938 S. Hampton Road with the following members present:
CITY COUNCIL:
Clark Choate * Mayor
Dan Freeman * Council Member
Kathy Dixon * Mayor Pro Tem
Mary Ann Chancellor * Council Member

Mayor Choate called the meeting to order at 7:34 p.m.

INVOCATION: Pastor Lugene Spurlock gave the invocation.

PUBLIC COMMENTS:

None

CONSENT AGENDA

1. Consider and approve the Minutes of the September 15, 2008 regular meeting and October 6, 2008 regular meeting.

Mayor Pro Tem Dixon moved to approve the minutes of the September 15, 2008 and October 6, 2008 with corrections to the October 6th minutes. Councilman Freeman made the second. The motion carried with the following vote:

VOTE: 5 Ayes - Freeman, Dixon, Choate, Chancellor, and Pereira

NEW AND OLD BUSINESS:

2. Consider canceling or rescheduling the November 3, 2008 regular meeting.

Councilman Freeman moved to cancel the November 3, 2008 meeting. Councilwoman Chancellor made the second. The motion carried with the following vote:

VOTE: 5 Ayes - Freeman, Dixon, Choate, Chancellor, and Pereira

3. Consider and approve Waste Management request for Consumer Price Index (C.P.I.) rate increase and the proposed amendment to the Waste Management Contract.

Councilwoman Chancellor moved to approve a CPI increase of 6.2 effective November 1, 2008 (New Rate $9.89) and the proposed amendment to the Waste Management Contract. Mayor Pro Tem Dixon made the second. The motion carried with the following vote:

VOTE: 4 Ayes - Dixon, Choate, Chancellor, Harvey, and Pereira
1 Nays - Freeman

4. Discuss and consider releasing the easement referred to on the Special Warranty Deed for 22.149-acre tract located in Lancaster, Texas, executed on the 17th day of July, 1989.

Councilwoman Chancellor moved to approve releasing the easement referred to on the Special Warranty Deed for 22.149-acre tract located in Lancaster, Texas, executed on the 17th day of July, 1989 conveyed from the Grantor (NCNB Texas National Bank, Trustee of the Patricia Darwin O'Conner Trust) to the City of Glenn Heights. Mayor Pro Tem Dixon made the second. The motion carried with the following vote:

VOTE: 5 Ayes - Freeman, Dixon, Choate, Chancellor, and Pereira

5. Consider and authorize the City Manager to lease/purchase four vehicles for a total estimated purchase price of $100,438.00, utilizing the H-GAC competitive bid process, with three annual payments of an estimated $36,111.00, financed through Ford Motor Credit Company.

Councilwoman Chancellor moved to approve the lease/purchase of four vehicles (2009 Ford Crown Victoria, 2009 Ford F350, 2009 E350 and 2009 Ford F150) for a total estimated purchase price of $100,438.00, utilizing the H-GAC competitive bid process, with three annual payments of an estimated $36,111.00, financed through Ford Motor Credit Company. Mayor Pro Tem Dixon made the second. The motion carried with the following vote:
VOTE: 3 Ayes - Freeman, Dixon, and Chancellor
2 Nays - Choate and Pereira

6. Consider and authorize the City Manager to enter into a Project Agreement with the Texas Department of Criminal Justice and authorize the City Manager to continue the Project indefinitely as renewal dates for the Agreement occur.

Councilwoman Chancellor made the second. The motion carried with the following vote:

VOTE: 5 Ayes - Freeman, Dixon, Choate, Chancellor, and Pereira

7. Discuss and consider Employee Appreciation Dinner/Ceremony.

Brief discussion on an annual employee appreciation event. The issue will be discussed by the City Manager's City Employees Advisory Committee and brought back to Council for action at a latter date.

RESOLUTIONS:

8. Consider and approve Resolution R-40-08 calling for the annual audit and authorizing the City Manager to engage the firm of Pingleton, Howard and Company, P.C.

Councilman Freeman moved to approve Resolution R-40-08 calling for the annual audit and authorizing the City Manager to engage the firm of Pingleton, Howard and Company, P.C. for an amount not to exceed $27,000. Councilman Pereira made the second. The motion carried with the following vote:

VOTE: 5 Ayes - Freeman, Dixon, Choate, Chancellor, and Pereira

9. Consider and approve Resolution R-41-08 supports the State Legislative Agenda for the 81st Texas Legislative Session as passed by the DART Board of Directors on August 26, 2008 in support DART

Councilman Pereira moved to approve Resolution R-41-08 supports the State Legislative Agenda for the 81st Texas Legislative Session as passed by the DART Board of Directors on August 26, 2008 in support DART. Councilman Freeman made the second. The motion carried with the following vote:

VOTE: 5 Ayes - Freeman, Dixon, Choate, Chancellor, and Pereira


ORDINANCES:

10. Consider and Approve Ordinance O-33-08 adopting a Clean Fleet Vehicle Policy. Second Reading

Mayor Pro Tem Dixon moved to approve Ordinance O-33-08 adopting a Clean Fleet Vehicle Policy. Councilwoman Chancellor made the second. The motion carried with the following vote:

VOTE: 5 Ayes - Freeman, Dixon, Choate, Chancellor, and Pereira

11. EXECUTIVE SESSION

CLOSED MEETING PURSUANT TO CHAPTER §551. TEXAS LOCAL GOVERNMENT CODE V.T.C.S. (OPEN MEETINGS LAW), IN ACCORDANCE WITH THE AUTHORITY CONTAINED IN SECTION §551.071 LEGAL, SECTION §551.072 REAL ESTATE AND SECTION §551.074 PERSONNEL.

A. Pursuant to Sec. §551.074, Government Code, regarding Personnel - to discuss the employment, duties, evaluation, discipline and termination of the City Attorney.
B. Pursuant to Sec. §551.074, Government Code, regarding Personnel - City Manager search.

Councilman Pereira moved to go into Closed Session pursuant to Section 551.074, Personnel. Councilwoman Chancellor made the second. The motion carried with the following vote:

VOTE: 5 Ayes - Freeman, Dixon, Choate, Chancellor, and Pereira

The City Council convened into Closed Session at 9:00 p.m.

Councilwoman Chancellor moved to come out of Closed Session. Councilman Freeman made the second. The motion carried with the following vote:

VOTE: 5 Ayes - Freeman, Dixon, Choate, Chancellor, and Pereira

Mayor Choate called the meeting back to order at 10:24 p.m.

12. Consider any Official Action as a result of the Executive Session.

No Action Taken.

13. ADJOURNMENT.

Mayor Pro Tem Dixon moved to adjourn. Councilman Freeman made the second. The motion carried with the following vote:

VOTE: 5 Ayes - Freeman, Dixon, Choate, Chancellor, and Pereira

Mayor Choate adjourned the meeting at 10:25 p.m.
